There is a $50.00 delivery & installation charge and a security deposit equivalent to one month's lease/service fee applied to each EasyGreenz™ installation.
 

Maintenance Options

A) Lease - Plants and containers are the property of Bill’s Greenhouse

No initial purchase expense.  Billed monthly for the leasing of plants, containers and weekly service.

B) Flower Rotation - Flowers will be replaced on a scheduled rotation

C) Bromeliad Rotation - Bromeliads will be replaced on a scheduled rotation

Services Include

1) Complete Weekly Care:

a)      A scheduled weekly service visit during our normal business hours.

b)      Includes watering, cleaning, trimming and other necessary services as needed to maintain the health and appearance for contracted plants.

2) Guaranteed Replacement:

a)      Contracted interior plants will be replaced at no charge if the appearance becomes unhealthy or unattractive.

b)      Plants will be replaced with a variety tolerant to the conditions and the same size as that being removed.

c)        Replacements are the property of Bill’s Greenhouse.

3) Replacements Not Covered:

a)      Plants relocated without written notification to Bill’s Greenhouse.

b)      Care of plants from anyone other than Bill’s Greenhouse.

c)       Excessive temperature below 60 degrees F. or above 80 degrees F.

d)      Lack of weekly access.

e)       Theft, vandalism or circumstances beyond our control.

f)        Personal plants not contracted.

g)      Containers will not be covered beyond manufacturers warranty.

h)      Insufficient lighting resulting from changes in original plan.

i)        Exterior plants.

4) Containers:

a)      No damage resulting from containers or planters will be covered.

5) Additional Services:

a)       Additional services such as arranging or moving plants, rescheduling weekly service visit, adding soil, mulch or any other work done on a separate visit from the scheduled weekly service visit.  Rates will be billed at materials plus labor costs.  These services generally need to be scheduled in advance.

6) On Site Storage and Access:

a)      If storage for equipment is needed we will need to have access to an adequate area, approximately 15 sq. ft. at no expense.

b)      Parking will need to be available for our service visits and deliveries.  Any incurred expenses such as parking fees will be added to your bill.

c)       Access to keys, codes, badges and water must be available for areas with plants.

Terms and Conditions

a)      This contract is for two years unless otherwise stated.  Since many of our cost are amortized over the life of the contract, should a major reduction or termination be requested prior to the completion of the contract period, your company is responsible for all remaining contract payments plus any unpaid balance on the account including collection, repossession and attorney’s fees.

b)      You agree that you will not solicit, contract or employ any representative or former representative of our company for the provision of plant sales/leasing or horticultural services within 12 months of the maturity/termination of this contract or 12 months from our representative’s separation from our company.

c)       The contract price may be adjusted subject to inventory on contract with written approval from Bill’s Greenhouse.

d)      This contract price is subject to review upon its renewal.

e)       All terms and requirements of this contract will be renewed automatically for one full year each succeeding year from its inception unless either party provides written notice to the other at least thirty days in advance of the contract expiration date.

f)        All payments are due net thirty days.  A 1.5% late fee will be added to overdue balances each month.

g)      Special orders require a 50% non-refundable down payment.  You agree to pay our expenses incurred on cancelled orders.

h)      All prices exclude applicable taxes unless stated otherwise.

You understand that you are entering into a legally binding contract between You and the the EasyGreenz™ Licensee indicated above. You further agree and understand that EasyGreenz.com, Interiorplantscaper.com, Fosterplants, Inc. and their successors, affiliates or subsidiaries or heirs are in no way entering into any type of contract with you.
